Our attorneys are proficient in alternative dispute resolution techniques, negotiated settlements, appeals, and traditional trial representation, as well as advice on the prevention of claims and avoidance of litigation. A number of our attorneys also serve as mediators, arbitrators and private judges.

We are at the forefront of implementing technology for the benefit of our clients, saving them money and helping us deliver more effective and efficient legal services. In the litigation setting, technology helps us save days of trial time for our clients. Our use of the "TrialDirector®," "CaseMap®," and "MindMap®" programs help us quickly manage substantial numbers of exhibits and photos, to conduct examinations and closing arguments.

We have the capability to set up technology-rich arbitrations both in-house and at external sites that visually help drive home key points in arguments.

We assist many clients in connection with mergers and acquisitions covered by the Hart-Scott-Rodino Act of 1976, and advise clients on antitrust and trade regulation issues affecting business conduct and transactions.

Our clients have included not only these entities, but their insurance carriers on litigation that has included defective design, defective construction, mold remediation and economic loss theories.

  • Eminent Domain

Our condemnation and eminent domain practice represents both condemning authorities and landowners in disputes regarding eminent domain. We have represented clients in the broadest variety of situations involving the exercise of eminent domain and inverse condemnation, throughout Arizona and Nevada. Our attorneys combine substantial experience in real estate and business transactions with negotiation, litigation and dispute resolution experience on eminent domain covering such matters as transmission lines, pipelines, rights-of-way for new roads and roadway expansion, rail, light rail, and communications lines. Our attorneys are successful litigators in complex condemnation and business valuation issues on both the right to take as well as valuation issues. We have represented condemning authorities and property owners in partial and total takings in cases involving inverse condemnation matters as well as traditional condemnations. We understand that delays and litigation are costly and we strive to assist clients in avoiding disputes or seeking cost effective resolution of disputes whenever possible.

We represent both landowners and condemning agencies in all aspects of eminent domain. These aspects include pre-condemnation planning, proper drafting of leases and other documents to account for future eminent domain actions, public hearings of the government agencies, and challenges to the government’s right to take a particular property for a particular use, at all.

Once the eminent domain case is filed, our attorneys have handled pre-trial litigation in the district courts, jury trials, and appeals to the higher courts. We are experienced in litigating direct condemnations, inverse condemnations, regulatory takings, and claims for precondemnation damages, in the context of many types of public projects, including pipelines, high voltage transmission lines, roads and freeways, buildings, and redevelopment projects.

In developing your case for the courts, we locate and work with appropriate witnesses, including expert witnesses (such as appraisers and engineers), so that the proper amount of just compensation is presented for the jury’s determination. Our preparation is very thorough, so much so that we often succeed in negotiating successful settlements for our clients.

Our attorneys can represent you in Nevada, Arizona, Colorado, and other states.
