E-Discovery and Data Management

Whether a client needs assistance developing a data management plan, responding to a litigation hold letter or discovery requests, or preparing policies on data preservation and destruction, Fennemore Craig's e-discovery attorneys can guide clients through the process. They are supported by the firm’s litigation technology resources team, which includes our Information Systems staff experienced in e-discovery and data management issues associated with litigation as well as outside computer forensics and information management resources. All contribute to the firm’s experience in complex litigation involving e-discovery.
Our e-discovery attorneys can be available, even before there is a dispute or litigation, to educate clients about their e-discovery obligations, prepare them to meet these obligations before the time pressures of litigation complicate the process, and assist them in developing and implementing comprehensive litigation hold policies. If litigation is reasonably anticipated or already filed, our e-discovery attorneys can be available to assist clients with complying with laws regarding preservation of evidence and rules of civil procedure applicable to disclosure, discovery and production of ESI. This includes, inter alia:
- working with clients and their document and information management technology, retention policies and litigation hold procedures;
- counseling regarding meet-and-confer, disclosure, discovery and production options, obligations, and safe-harbors;
- utilizing forensic experts for data discovery, collection, preservation, production and analysis, and for addressing evidentiary issues at hearings and trial;
- formulating and responding to e-discovery requests;
- preparing client witnesses for depositions, hearings and trial regarding e-discovery topics; and
- deposing and examining witnesses at hearing or trial regarding the other side’s e-discovery policies and procedures.
Upon request, our e-discovery attorneys can also work with clients to alert them on new developments in e-discovery, using e-newsletters, firm events on e-discovery and data management, and presentations at a host of seminars. They can provide in-house presentations on e-discovery for a client’s internal staff as well.
