Donald R. Gilbert
Don Gilbert has chaired both Fennemore Craig’s Litigation Section and its Employment and Labor Practice Group. He represents clients in connection with a broad range of employment-related issues before the NLRB, the EEOC, the Department of Labor, the Arizona Civil Rights Division and the Arizona Department of Economic Security. He is an experienced litigator, with trials in both state and federal courts, as well as before administrative law judges of the NLRB. He has tried more than 100 labor arbitrations, as well as arbitrations involving disputes in the financial industry. He frequently litigates matters seeking or opposing injunctive relief, often involving employee loyalty, trade secrets, and restrictive employment covenants. He has significant experience litigating spoliation of evidence claims, including forensic analysis of electronically stored information and E-Discovery.
Drawing upon the breadth of his experience, Don counsels national and Arizona-based clients on a wide range of employment issues. He has designed and implemented comprehensive employment audits to assist clients in identifying and correcting high-risk employment practices. He has assisted both publicly and privately held companies in developing effective compliance plans, and led the training of the entire supervisory work forces of at least 17 large employers located in 13 different states.
